“On January 7, 2022, at about 19.30, the defendant (soldier Arman Zhuman - KazTAG), while at the checkpoint, gave the military personnel under his command an illegal order to open fire on a car approaching the checkpoint. As a result of the shelling, the passengers of this car, a minor (born in 2017, A. Meldehan), received a gunshot wound from which she died, and a minor (born in 2006, J. Meldehan) received five gunshot wounds, causing grievous harm to health,” the court said.
The guilt of the convicted person is proven by the testimony of victims and witnesses, expert opinions, reports of the inspection of the scene of the incident and physical evidence.
“A private resolution was issued to the Minister of Defense of the Republic of Kazakhstan on violations of the law committed by military personnel, as well as the reasons and conditions that contributed to the commission of the crime in order to take measures to eliminate them and prevent them from happening in the future,” the court added.
